This Privacy Statement helps you understand what personal data we collect about you, why it is collected and how it is used by us. It also clarifies how you can exercise your rights in relation to the personal data you entrust us with and explain how Mobinck processes your data in accordance with privacy legislation and regulations. 1. Personal data that we collect

1.1 When you contact us via telephone (incl. whatsapp), the webform or via

When contacting us via our website, telephone, the webform and/or by e-mail, we will process your personal data based on the performance of a contract (to reply to your enquiries). Depending on the means of communication, we will ask for (and process) the following information: name, email address, phone number, the content of the mail/app etc.

Retention Period

We will store your personal data for the period needed to fulfil your request/contact, after which your personal data is deleted. Telephone calls are not recorded by Mobinck.

1.2 When you register to receive our digital magazine, a newsletter or a whitepaper

When you subscribe to receive Mobinck’s digital magazine or newsletter and/or a whitepaper via our website, you consent that we process your personal data. In the event you subscribed to receive a certain free information (e-books) or a specific whitepaper, we will process your personal data based on our legitimate interest, due to the fact that Mobinck and you will have joined into a customer relationship. For said subscriptions and/or the download of free content, Mobinck will need (and process) the following data: name, e-mail address.

Retention Period

We keep your data as long as you are subscribed to our digital magazine and/or newsletter. You will be able to opt-out in every e-mail communication we will send you.

1.3 When you visit our website as a user

As a visitor of our website, based on our legitimate interests, we may analyse trends, administer the Website, measure User’s activity on the website and gather demographic information about our user base. Further information you will find here in our cookie policy.

1.4 When you attend a Mobinck event

Invitations to Mobinck events are legitimate based on existing relationships with Mobinck and/or any of its ventures: employment, contractual, or business partnerships. The processing of personal information is related to the events’ planning, invitations, organization, security and/or promotion. If we intend to use your data for marketing purposes as well, we will always ask your permission to do so.

Mobinck may photograph and record the event for promotional purposes: when this is the case, you will be informed about it on-site. When attending the event, processing of your image is based on your consent (signed with stickers, lanyards, etc). Please note that background and group video and images may be taken. For (the invitation to) an event of Mobinck, we may request the following information: name, (e-mail) address, telephonenumber, family members (when applicable), dietary wishes (when applicable), image.

Retention period

Personal data required for the event are event-based and deleted after the event has finished. If you gave your consent to use your data for marketing purposed, we will keep your data up to the moment you unsubscribe or opt-out for further communication. For promotional material (video and images) made available in online and printed version, a retention period does not apply (freedom of expression and information – article 85 GDPR and Article 43 AVG).

2. Protection of your personal data

Mobinck has taken appropriate technical and organizational security measures in order to protect your personal data against loss, misuse, alteration and/or destruction. This concerns both measures in the field of ICT security, access to buildings and files, as well as internal rules of conduct aimed at personal discipline when dealing with confidential data of individuals. Although we exercise your equipment and our systems, we cannot ensure or warrant the security of any information transmitted to us over the internet.

3. Sharing your data

Mobinck is the controller with respect to any personal data that you provide as mentioned in “Personal data we collect”. We can use certain (sub-)processors, but these sub-processors only process (use) the personal data that is strictly necessary for these sub-processers to complete their specific task of service. We only provide your personal data, subject to data processing agreements, which state that the (sub-)processors must keep your data confidential, that the data cannot be used for their own purposes and that all information will  be used in accordance with applicable privacy legislation, including strict provisions on data security.

We reserve the right to transfer your data to a country outside the Economic European Area or international organisation. If so, we will ensure that the appropriate and required safeguards and transfer mechanisms shall be in place. Besides the recipients specifically mentioned in “Personal data we collect”, Mobinck may also share your data with:

(i) Mobinck entities

Access to your data is limited by need. We may disclose and/or receive your personal data to/from other Mobinck entities when it is necessary for business, administrative or recruitment purposes. Other Mobinck entities which might access your personal data are also committed to the terms of this privacy statement

(ii) Third parties and other recipients for security or other legitimate purposes, such as:

  • To comply with valid legal obligations including court orders, governmental requests, legal claims, regulatory requirements and as otherwise authorized by law;
  • To protect against fraudulent, malicious, abusive, unauthorized or unlawful use of this website and/or our network;
  • To protect our rights and property, or safety of our employees and visitors, according to local legislations;
  • To perform audit and investigations, when solicited by auditors and regulators;
  • For IT infrastructure and services;
  • For data storage, management and protection.

4. Your Rights

Under the privacy legislation, you are in control of the personal data you share with us and you are given a number of rights:

The right of access – if we process your personal data, you have the right to access your personal data and obtain a copy.

The right to rectification – if your personal data is incorrect, you have the right to ask us to rectify your personal data. We will rectify your personal data accordingly.

The right to erasure (‘to be forgotten’) – if you want us to delete your personal data, you have the right to request us to do so. We will delete your personal data, unless we have a legal obligation to keep processing your personal data.

The right to restrict processing – certain situations give you the right to request us to restrict the processing of your data. For example if you are contesting the accuracy of your personal data (and we need time to verify) or if you are to the opinion that your data has been unlawfully processed. As a consequence, we cannot process your personal data, but we can keep your personal data.

The right to data portability – you can request us for an export of all the personal data that is processed by Mobinck.

The right to object – in this event we will not process any of your personal data upon your objection unless we can provide you with compelling reasons to continue the processing of your personal data.

We understand that protecting privacy is an ongoing responsibility and, for this reason, we keep our Privacy Statement under regular review.
